Welcome to Hobby Vault. These Terms of Service (“Terms”) govern your access to and use of www.hobbyvault.com (the “Site”), including purchases made through the Site and related services offered by Hobby Vault Incorporated (“Hobby Vault,” “we,” “us,” or “our”).

By accessing the Site, placing an order, creating an account, or otherwise using our services, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.

1. About Hobby Vault

Hobby Vault is a retailer of trading cards, collectible card games, sealed products, individual cards (“singles”), professionally graded cards, accessories, collectibles, and related products.

2. Eligibility and Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms.

By placing an order, you represent that the information you provide is accurate and that you are legally permitted to make the purchase.

You may not use the Site to engage in fraudulent activity, interfere with the operation or security of the Site, attempt unauthorized access to any portion of the Site, submit false or misleading information, or violate any applicable law or regulation.

We reserve the right to refuse service, restrict access, cancel orders, or terminate accounts when reasonably necessary to protect Hobby Vault, our customers, or the integrity of our services.

3. Products and Collectibles

Hobby Vault sells products that may include:

Sealed trading card game products
Booster packs and boxes
Individual trading cards (“singles”)
Professionally graded cards and slabs
Collectibles
Gaming accessories
Other hobby-related merchandise

Collectibles can vary in condition, appearance, printing, packaging, centering, and other characteristics.

We make reasonable efforts to accurately describe and display our products. However, photographs, colors, packaging, promotional materials, and other visual representations may differ slightly from the product received.

For singles, graded cards, vintage products, and other unique collectibles, product images may depict the actual item being offered for sale when indicated on the applicable product listing.

4. Card Condition

Any condition designation assigned by Hobby Vault to an ungraded card represents our reasonable assessment of that card at the time it is listed or sold.

Card condition can be subjective. Different collectors, dealers, marketplaces, or grading companies may evaluate the same card differently.

Purchasing an ungraded card from Hobby Vault does not guarantee that the card will receive any particular grade if subsequently submitted to a professional grading service.

5. Graded Cards

Professionally graded cards are sold based on the grade and certification provided by the applicable third-party grading company.

Hobby Vault is not affiliated with and does not control the standards, grading processes, opinions, or future decisions of third-party grading companies such as PSA, CGC, Beckett, or other grading services.

A graded card's future market value, grading status, population, or eligibility for crossover or regrading is not guaranteed.

All sales of graded cards are final.

Please review the product listing and available photographs carefully before purchasing a graded card.

6. Pricing and Market Fluctuations

Trading cards and collectibles are market-driven products whose values can change rapidly.

Prices may increase or decrease after a purchase due to market conditions, product availability, competitive play, reprints, announcements, collector demand, or other factors outside Hobby Vault's control.

The price charged for an order is the price applicable when the order is accepted, subject to correction of obvious pricing or listing errors.

Hobby Vault does not guarantee the future market value of any product and does not provide refunds, credits, or price adjustments solely because the market value of an item changes after purchase.

7. Pricing and Listing Errors

We make reasonable efforts to ensure that product descriptions, prices, inventory, and other information are accurate.

Occasionally, typographical errors, incorrect prices, inventory discrepancies, technical errors, or other mistakes may occur.

To the extent permitted by applicable law, Hobby Vault reserves the right to correct errors and to cancel or decline an affected order before fulfillment. If we cancel an order after payment has been collected, we will refund the amount collected for the canceled portion of the order.

8. Inventory and Availability

Products displayed on the Site are subject to availability.

Because Hobby Vault operates both online and retail operations, inventory may occasionally sell in-store or through another sales channel before online inventory records are updated.

Adding an item to your cart does not reserve that item.

We reserve the right to limit quantities or cancel an order when inventory is unavailable or when we reasonably believe an order involves fraud, abuse, a listing error, or unauthorized resale activity.

If we cancel an order for which payment has already been collected, the applicable amount will be refunded.

9. Orders

Submitting an order does not necessarily mean that Hobby Vault has accepted the order.

We may review orders for inventory availability, payment authorization, suspected fraud, pricing errors, quantity limitations, or other legitimate business reasons before fulfillment.

We reserve the right to accept, decline, limit, or cancel orders as permitted by applicable law.

10. Payment

Customers agree to provide current, complete, and accurate billing and payment information.

By submitting payment information, you represent that you are authorized to use the selected payment method.

Payments may be processed by Shopify or other third-party payment processors. Your use of those payment services may also be subject to the provider's applicable terms and privacy practices.

11. Shipping

Shipping times displayed on the Site are estimates unless expressly stated otherwise.

Hobby Vault is not responsible for delays caused by shipping carriers, weather, natural disasters, incorrect addresses provided by customers, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address when placing an order.

If you believe your package has been lost, damaged, or incorrectly delivered, please contact Hobby Vault as soon as possible so that we can assist with the appropriate carrier process.

Nothing in this section limits any rights or remedies available to you under applicable law.

12. Returns and Refunds

Purchases are subject to our separate Return & Refund Policy, which is incorporated into these Terms by reference.

In summary:

Eligible sealed products may be returned within 14 days, subject to the conditions stated in our Return & Refund Policy.
Opened, unsealed, or tampered-with sealed products are not eligible for return except where required by law.
Individual trading cards (“singles”) are final sale.
Professionally graded cards are final sale.

13. Order Cancellations

If you need to cancel an order, contact Hobby Vault as soon as possible.

We cannot guarantee that an order can be canceled once it has entered processing, packing, shipment, or pickup preparation.

Orders that have already shipped are subject to our Return & Refund Policy.

14. Local Pickup

When local pickup is offered, customers are responsible for collecting their order from the designated Hobby Vault location.

Customers may be required to provide the order confirmation, identification, or other reasonable verification before an order is released.

15. Events and Organized Play

Hobby Vault may host trading card tournaments, leagues, open play, prerelease events, and other in-store activities.

Event schedules, formats, entry requirements, prizes, capacity, and other details may change.

Participation may also be subject to rules established by the applicable game's publisher, tournament organizer, or organized-play program.

Hobby Vault reserves the right to enforce reasonable store and event rules designed to maintain a safe, fair, and enjoyable environment.

16. Buying, Selling, and Trading Cards

Hobby Vault may separately offer services involving the purchase of cards or collectibles from customers or trades involving store inventory.

Unless expressly stated otherwise, transactions in which Hobby Vault purchases or accepts cards from a customer are separate from purchases made through the Site and may be subject to additional terms, identification requirements, valuation procedures, or store policies.

Hobby Vault is not obligated to purchase or accept any particular card or collectible.

17. Intellectual Property

The Site and its original content, branding, graphics, text, logos, photographs, design elements, and other materials owned by Hobby Vault are protected by applicable intellectual property laws.

Names, logos, artwork, card designs, game materials, and trademarks belonging to Pokémon, Disney Lorcana, Magic: The Gathering, One Piece, and other publishers or rights holders remain the property of their respective owners.

The sale or display of products associated with those brands does not imply sponsorship or endorsement of Hobby Vault unless expressly stated.

18. Third-Party Services and Links

The Site may use or link to services operated by third parties, including Shopify, payment processors, shipping carriers, grading companies, publishers, social media platforms, and other service providers.

Hobby Vault does not control third-party websites or services and is not responsible for their content, availability, policies, or practices.

19. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site and its services are provided on an “as is” and “as available” basis.

Hobby Vault does not guarantee that the Site will always be uninterrupted, error-free, or free from harmful components.

Products are subject to any warranties provided by their applicable manufacturer or other rights holder, if any.

Nothing in these Terms excludes warranties, rights, or remedies that cannot legally be excluded under applicable law.

20. Limitation of Liability

To the fullest extent permitted by applicable law, Hobby Vault and its officers, employees, affiliates, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Site, purchase of products, or use of our services.

To the fullest extent permitted by applicable law, Hobby Vault's aggregate liability arising from a particular purchase will not exceed the amount paid to Hobby Vault for the product or transaction giving rise to the claim.

These limitations do not apply where prohibited by applicable law.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Hobby Vault Incorporated and its officers, employees, and representatives from claims, damages, liabilities, and reasonable expenses arising from your unlawful use of the Site, your violation of these Terms, or your infringement of another person's rights.

22. Privacy

Your use of the Site is also subject to our Privacy Policy.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, services, policies, or legal requirements.

When we make changes, we will update the “Last Updated” date at the top of this page.

Changes apply prospectively from their effective date unless otherwise required by law.

24. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles, except to the extent applicable federal law or other mandatory law provides otherwise.

25. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

26. Entire Agreement

These Terms, together with the Privacy Policy, Return & Refund Policy, and any other policies expressly incorporated by reference, constitute the agreement between you and Hobby Vault concerning your use of the Site and purchases through it, except where separate written terms apply.
